Privacy Notice

In compliance with Mexico's Federal Law on the Protection of Personal Data Held by Private Parties, its Regulations, and other applicable provisions (collectively, the "Law"), LINTWORKS (hereinafter "Lintworks," "We," or the "Controller") provides this Privacy Notice (the "Notice").

You acknowledge that by contacting us through our website, email, electronic forms, or any other physical or digital means, you accept the terms of this Privacy Notice.

1. Data controller and contact information

Lintworks, with address at Privada Manuel Doblado 2721, Interior 501, Piso 5, Calete, 22044, Tijuana, B.C., Mexico, is responsible for processing the personal data you voluntarily provide through our website, contact forms, email, or any other electronic, optical, audio, visual, or other technological means.

2. Personal data we collect

Lintworks may collect the following personal data:

  • (a) Full name.
  • (b) Email address.
  • (c) Approximate geographic location derived from your IP address.
  • (d) Company or business name.
  • (e) Information related to operational processes or business needs that you choose to share with us.
  • (f) The content of messages sent by email or through contact forms.

Lintworks does not intentionally request or collect sensitive personal data, including financial, biometric, medical, or health information, through its website or contact forms.

3. Purposes of processing personal data

3.1 Primary purposes

  • (a) Respond to contact requests, inquiries, or messages sent by the User.
  • (b) Carry out assessments, diagnostics, or operational reviews requested by the User.
  • (c) Follow up on potential commercial or professional relationships.
  • (d) Prepare proposals, quotes, or documentation related to Lintworks' services.
  • (e) Maintain communication with the User regarding services contracted or under discussion.
  • (f) Keep internal records related to projects, services, and communications.
  • (g) Comply with applicable legal, regulatory, or contractual obligations.

3.2 Secondary purposes

Lintworks does not currently use personal data for secondary purposes such as advertising, marketing, commercial profiling, or sending promotional communications.

Should Lintworks intend to use your personal data for secondary purposes in the future, your consent will be requested beforehand where required by applicable law.

Lintworks will retain personal data only for as long as necessary to fulfill the purposes described in this Notice, as well as to comply with applicable legal, tax, or regulatory obligations.

4. Transfer of personal data to third parties

Pursuant to Article 36 of the Law, Lintworks may transfer personal data, without requiring additional consent from the data subject, in the following cases:

  • (i) When the transfer is made to holding companies, subsidiaries, affiliates, or entities under the same corporate control as Lintworks that operate under internal processes and policies compatible with this Notice.
  • (ii) When the transfer is necessary by virtue of a contract entered into, or to be entered into, in the data subject's interest.
  • (iii) When the transfer is necessary to comply with legal obligations or the requirements of a competent authority.
  • (iv) When the transfer is necessary for the recognition, exercise, or defense of a right in a judicial proceeding.
  • (v) When the transfer is necessary to maintain or fulfill a legal relationship between Lintworks and the data subject.

Likewise, Lintworks uses third-party providers to receive, store, and manage contact forms and electronic communications. These providers may temporarily process personal information on behalf of Lintworks in accordance with their own privacy terms.

Lintworks does not sell, trade, or share personal data with advertising networks or third parties for marketing purposes.

6. Security measures

Lintworks has implemented reasonable administrative, technical, and physical measures to protect personal data against damage, loss, alteration, destruction, or unauthorized access or processing.

Nonetheless, the User acknowledges that no electronic transmission or storage system is completely secure, and therefore Lintworks cannot guarantee absolute security.

7. Cookies and similar technologies

The Lintworks website currently does not use first-party analytics tools, advertising tracking, or cookies intended to track User behavior.

Notwithstanding the foregoing, some third-party providers used to receive and manage forms or communications may use cookies or similar technologies in accordance with their own privacy notices.

Should analytics tools or additional cookies be implemented in the future, this Notice will be updated before their implementation.

The User may configure their browser to block or delete cookies according to the options available within it.

8. Information retention

Lintworks will retain messages, forms, and records related to communications or services for as long as necessary to:

  • (a) Maintain active commercial relationships.
  • (b) Follow up on requests or projects.
  • (c) Comply with legal, tax, or regulatory obligations.
  • (d) Defend the legitimate rights and interests of Lintworks.

Afterward, the information may be deleted, anonymized, or blocked in accordance with internal information-retention policies.

9. Procedure for communicating changes to the Privacy Notice

Lintworks reserves the right to modify or update this Privacy Notice at any time to reflect legislative, regulatory, or internal changes, or changes arising from new services.

Any modification will be published on the corresponding website or communicated by electronic means where applicable.

The date of the last update will be indicated at the top of this Notice.
